Howard to Courtroom: Anna Wanted to Be Buried Near Marilyn Monroe

In what is surely the courtroom battle of the year, Anna Nicole Smith’s lawyer and rumored lover Howard K. Stern took the witness stand on Tuesday.

After swearing in under the ruling of a Florida judge, Stern revealed Anna Nicole’s secret wish: to be buried near her idol, Marilyn Monroe, TMZ.com reports.

Stern added that Smith knew that it wouldn’t likely happen because it was “prohibitively expensive.”

The embattled lawyer also confided to the courtroom that like Marilyn, Smith also predicted she would die young.

“She thought she would die while giving birth to Dannielynn” he shared. “She talked of death really from the time I met her.”

While Stern loved Anna dearly, he told the judge that Anna’s second husband, J. Howard Marshall, was “truly, truly the love of her life.”

“Extra’s” Carlos Diaz is inside the courtroom today covering the trial that will ultimately decide who has jurisdiction over Anna Nicole Smith’s body. Below are some additional details from the proceedings:

Stern and Larry Birkhead are sitting less than four feet away from each other. Smith’s mother, Virgie Arthur, is sitting to the left of Stern.

As the attorneys were talking about Smith’s body being embalmed, Stern had his head in his hands. He was shaking his head slowly back and forth as if everything was too difficult for him to hear.

Smith’s father, Donald Hogan, is in the courtroom. At one point during the hearing, Birkhead’s sister came and gave Hogan a big hug.

Birkhead was nodding his head vigorously when the judge referred to him as a man in the courtroom who believed he is the biological father of Dannielynn.

For much of the proceeding, Stern has sat expressionless, staring blankly forward with his head down. The only time he looks up is when the judge interrupts his attorney or there is an objection.

Arthur is constantly holding hands over her right shoulder with her husband.

The coroner, Dr. Joshua Perper, complained that he couldn’t hear what was going on from his seat in the back of the courtroom. So, the judge moved him up into the jury box.

why hasn’t the DNA test been done? by what i have read, the judge made sure there was plenty of DNA material before she was laid to rest. this stern fellow is a money grabbing low-life just waiting to gain control a hugh piece of pie hiding under the guise of the weeping widow, so to say. the truth shall set you free, my friend. the true father is the other guy desperately fighting for his daughters’ rights and his rightful place. this is placing an unfair distance between his relationship with his daughter, giving that scumbag stern more time to be the ‘lawyer’, or the devil’s advocate. greed, that why it is one of the seven deadly sins!

What many people do not realise is there is no money in Anna Nicole’s estate at the moment only debts which Howard K Stern is fully aware of yet he kept working for her for nothing.
If it was not for him Anna Nicole’s estate would not even be in a position to put in another claim for Anna’s inheritence from Howard Marshalls estate.
If Howard K Stern is not successful all that the money grubbers comming out of the woodwork and the malicious mother will be able to get their greedy paws on are Anna Nicoles debts.
Who’ll want the baby then?

Howard K. Stern was entrusted in 2001 to take charge of Daniel W. Smith, Anna’s beloved son, should anything happen to Anna. She wouldn’t have left what to her was her most prized and proudest, her son, to someone she didnt trust or love. Anna had said in many occassions that Howard is her BEST FRIEND. Even Larry Birkhead stated they had a strong friendship and he handled almost every aspect of her life for her, that in his opinion he provided for her legal, management, and contractual affairs in kind. Even he agrees that Anna would want to be buried with her son, and I am not warm to Larry at all, but today in the courts what he said made sense. He’d want Anna to be in California, but since Daniel is in the Bahamas, he’d want her to be with him. That’s absolutely the RIGHT THING TO DO!!!

To me, he’s NOT the ogre that everyone thinks he is —- I feel he truly loved her, and maybe she didnt return that love to him but finally started to realize that this man has been by her side for 10 years and maybe JUST MAYBE she was going to turn her life around and did begin to love Howard as not just her best friend, but her husband. I saw the pictures of the committment ceremony and Anna seemed happy —- it was supposed to be a real wedding but Howard thought it was too soon after Daniel’s death and they were waiting until end of Feb. That makes sense… no husband would want their anniversary to be so close to a death like that.

Its my hope that Howard gets his wish to bring her back to their home in the Bahamas, and its my hope that Larry Birkstead bring his fight for paternity to the country of Danielynn’s birth, the Bahamas as Anna had wished the fight to play out. I think that’s really why Howard is dragging his feet, because Larry seems like he’s this big shot and wants to dictate where and how this is all to be handled. I for one believe in Howard, and hell… I’d hire him as my lawyer if I ever needed one.

I think Anna needs to be put to rest next to her son . It seems to me that she loved him with all her heart. If her mom wants to do the right thing then she should let her be next to her on son. I think this has gone on long enough, it is time to lay her to rest. And let her be ,and rest in peace . I think every person deserves that. I think some of the people want the baby because she comes with alot of money. And that is really sad. This whole thing is really sad……………..

Virgie ,Larry are only after money you can see it in this woman’s face.Why in the world would she dare to show her face.Like i said before Larry is huggin and talking with Virgie,poor anna to have all this people backstab her.I am so glad they show the tape and let it be known that she did not like any of her family members and half of them are on drugs for what i saw in her show.And this woman wants to be a holy mother now?Howard should stay with the baby as for Larry that low life is after money.How can he even talk to the woman who made Anna suffer the most.I don’t beleive anything that comes out of them two.The judge needs to hurry up so she can rest in peace the BAHAMAS.

The judge, like Virgie, is out to make a name for himself and some cash. Both off of Anna Nicoles name. This judge is an embarrassment to Judges everywhere. He lacks professionalism, doesnt take anything serious, and is dragging this delayed burial out for his own “air time” on tv.

Baby Dannilynn was born in the Bahamas and is a LEGAL resident. What gives this circus sideshow Judge the right to have any jurisdiction over paternity, or who she’ll live with?

I cant imagine any tv network wanting to put this judge on television in his own show. Id never feel confident in his rulings if I ever had to face him in court. He reminds me of a judge that should have been on “My cousin Vinny”.

OMG!!Im not the type of person to judge someone until I get to know them. BUT Virgie Arthur has really disgusted me these past 2 weeks. She knows that her daughter could not stand her. Yet Virgie is trying to pursue getting her body. Virgie’s last effort to get a little attention , and money before the Anna lime light fades away for good. What a sick twisted mother .

As for Larry, he may or may not be the father. But Howard is listed on that birth certificate as of now and until the dna is tested and the outcome revealed I think Larry should stick to his court date in California.

I feel for Howard Stern. You can see a man who’s emotionally drained. I truly believed he loved Anna. And you could see the love he has for the baby. I hope that whoever the dad is will include Howard in their lives, its what Anna would have wanted.

THIS IS OUTRAGEOUS!
Someone needs to step in and let this woman rest in peace. Whether any of us agree with her lifestyle or not she clearly is a human being and deserves to be buried and allowed to have her loved ones tell her goodbye.
She clearly did not have a relationship with her family and any mother knows that if there child passes on prior to them they would want to be buried alongside there child. Honor her wishes and allow her to be with her son.
Shame on her birth Mother for delaying her resting place and for being so selfish and wanting to have the last word. Blood is not always thicker than water and some Mothers do have alternative motives and some have the lack of being able to love there daughters but know how to be jealous of them.

Anna, I understand, you now have a stronger love than you ever may have had by your birth mother and you will be loved in a better place so you can stop looking for love in all the wrong places because you are loved.

This judge is grandstanding for the public for what he hopes will be a great financial windfall in his behalf. I bet he already has the actor picked out in his mind who should play him in the Anna Nicole movie. He doesn’t stay on track, he asks questions for the other attorneys and acts like he has his mind made up because he “knows it all, knows” what the attorneys next steps will be. He would LOVE to be the judge to determine the paternity of DannieLynn, and seems to be trying to manipulate that issue as well. Judge Seidlin, you are going to put your name right up there with the other well-known Broward County name, Hanging Chad!

I feel this judge is milking this case. He has had how many days to release Anna’s body to whom ever. He has already been offered a TV spot. Why cant he just release her and let her be at peace once and for all. As far as who is the father of Baby Danielle Lynn, get the DNA Tests done so this child can be with her daddy whom I believe is Howard Stern. How long can she stay at the coroners. Ito lost control of his courtroom and the trial, this judge is himself out of control. He is a disgrace and an embarrassment to his profession and the judicial system. Not only should he be removed from the case, but also he should be removed from the bench.
Anna buried her son in the Bahamas, she bought a plot next to him. She wanted to be buried in the Bahama. End of story.

Anna needs to be burried by her son. PERIOD! Her nasty mother needs to back off, we all know what that is really about. ATTENTION! Howard needs to take Dannielynn away from the public and let her grow up in at least a semi normal home. She is the innocent one here. And everybody seems to have forgotten that. This is not about the money, the grave, or the entertainment. It’s about a little girl who has lost her mom and her brother. Give them a break and leave them be!
